Menu Foods
Along with Sutts, Strosberg LLP, Falconer Charney LLP, Himelfarb Proszanski LLP, and Rochon Genova LLP, we are jointly prosecuting an action against Menu Foods Operating Limited Partnership, Menu Foods, Inc., Menu Foods Midwest Corporation and Menu Foods Limited (Ontario) (the "defendants") in the Ontario Superior Court of Justice.
The Ontario action was commenced on behalf of all persons in Canada who purchased or acquired dog and/or cat food in Canada and/or owned a dog or cat that consumed food that was included in the March 16, 2007 recall as amended from time-to-time issued by the defendants.
On March 16, 2007 the defendants announced they were recalling certain cans and pouches of dog and cat food after several animals died after ingesting it. The plaintiffs allege that the defendants were negligent in the preparation and manufacturing of the pet food which was subject to the recall.
The plaintiffs and the defendants have exchanged certification material. Class counsel expects to obtain a date for the hearing of the certification motion shortly.
